Administrative Regulation 303.15A 

Signing Contracts

All contracts shall be signed by the Board President. 

Contracts are defined as:  A binding agreement between two or more parties in which there is a promise to do something in return for a valuable benefit known as consideration.

A contract exists when the following elements are in place:  1) an offer, 2) an acceptance of the offer, 3) a promise to perform, 4) a valuable consideration (which can be a promise or payment in some form), 5) a time or event when performance must be made, 6) terms and conditions for performance, and 7) performance.

If you are unsure whether or not the document you have requiring a signature is a contract, please contact the Superintendent or CFO.

The following procedures shall apply to all contracts:

  1. All contracts requiring a signature shall be recommended by a district administrator.
  2. The contract shall be submitted to either the Superintendent or CFO for review and approval.
  3. After approval by the      Superintendent or CFO, the Board Secretary shall obtain the BoardPresident’s signature by a means described below.
  4. After the Board President has signed the contract a copy of the signed contract will be returned to the      administrator making the recommendation.
  5. Under  no circumstances shall anyone but the Board President sign and enter into  a contractual arrangement on behalf of the district.

Procedures to be followed in obtaining the board president’s signature are as follows:

  1. Maintenance  Contracts/Agreements

After approval by the Superintendent or CFO, the Board Secretary shall affix the Board President’s signature by stamp or other mechanical means.

  1. Contracts under $25,000

After approval by the Superintendent or CFO, the Board Secretary shall affix the Board President’s signature by stamp or other mechanical means.

  1. Contracts $25,000 to $50,000

Contracts of $25,000 to $50,000 in value, excluding those items listed in “A” above, will be included in the consent agenda to be signed by the Board President following the meeting at which the consent agenda is approved.

  1. Contracts $50,001 and over

Contracts of $50,001 or more in value, excluding those listed in “A” above, will be placed on a board agenda for approval and then signed by the Board President.

  1.  Contracts/Agreements Payable to District

Contracts and agreements that the District enters into whereby the District receives funds shall be recommended by a district administrator for approval to the Superintendent or CFO.  After approval, the Board Secretary shall affix the Board President’s signature by stamp or other mechanical means.
